Do you use email marketing in your business? The CAN-SPAM Act is a US law that establishes the rules and requirements for commercial email, gives recipients the right to have you stop sending them unwanted email messages, and establishes severe penalties for violations. Ultimately, the CAN-SPAM Act helps you maintain good practices when sending email marketing campaigns.

Despite its name, the CAN-SPAM Act doesn’t just apply to bulk email. It covers all commercial messages, which the law defines as “any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service,” including emails that promote content on commercial websites. The law makes no exception for business-to-business email. This means that all emails, for example, a message to former customers announcing a new product line, must comply with the law.
In the US, each email sent that violates the CAN-SPAM Act can result in penalties of up to $16,000, so non-compliance can be quite costly. However, complying with the law is not complicated. Here is a summary of the main CAN-SPAM requirements:
Don’t use false or misleading header information. Your “From,” “To,” “Reply-To,” and routing information, including the originating domain name and email address, must be accurate and identify the person or company that initiated the message.
Do not use misleading Subject lines. The subject line must accurately reflect the content of the message.
Identify the message as an advertisement. The law gives you a lot of leeway in how you do this, but you must clearly and conspicuously disclose that your message is an advertisement.
Tell recipients how to opt out of receiving future emails from you. Your message should include a clear and prominent explanation of how the recipient can opt out of receiving future emails from you. Write the notice in a way that is easy for the average person to recognize, read, and understand. Creative use of type size, color, and placement can improve clarity. Provide a return email address or another easy, web-based way for people to communicate their choice to you. You can create a menu to allow a recipient to opt out of certain types of messages, but you should include the option to stop receiving all commercial messages from you. Make sure your spam filter does not block these opt-out requests.
Promptly honor opt-out requests . Any opt-out mechanism you offer must be capable of processing opt-out requests for at least 30 days after your message is sent. You must honor a recipient's opt-out request within 10 business days. You may not charge a fee, require the recipient to provide personally identifiable information other than an email address, or require the recipient to take any action other than sending a response email or visiting a single page on a website as a condition of honoring an opt-out request. Once people say they no longer wish to receive messages from you, you may not sell or transfer their email addresses, even in the form of a mailing list. The one exception is that you may transfer the addresses to a company you have hired to help you comply with the CAN-SPAM Act.
Monitor what others are doing on your behalf. The law makes it clear that even if you hire another company to handle your email marketing, you cannot hire out your legal responsibility to comply with the law.
